Terms of Use (English Translation)

Article 1: Introduction

  1. These Terms of Use define the conditions for using the service provided by TetraChroma Inc.
  2. By using the service, users are deemed to have agreed to all terms described here.

Article 2: Definitions

  1. "Service" means Irasutoya Maker and related services.
  2. "User" means any person using the service.
  3. "Rights Holder" means the illustration provider, Irasutoya (Takashi Mifune).
  4. "Materials" means source assets provided to the service.
  5. "Generated Image" means an image produced by combining those materials.
  6. "Commercial Use" means use for direct or indirect profit; company use is considered commercial.
  7. "Editing" means modifying a generated image (for example, changing colors or drawing additions), excluding edits that infringe moral rights.

Article 3: Scope of Use / Commercial Use

Users may use generated images within these terms for personal or corporate purposes, and for commercial or non-commercial purposes.

Article 4: Copyright Ownership

  1. Intellectual property rights for the service system (programs, servers, UI design, etc.) belong to the company.
  2. Copyright and related rights for materials and generated images belong to the rights holder. Creating or editing images does not transfer copyright to users.

Article 5: Prohibited Acts

The following acts are prohibited (non-exhaustive):

  1. Illegal acts or acts contrary to public order and morals.
  2. Acts related to crimes.
  3. Interference with servers, networks, or service operation.
  4. Sending malicious programs.
  5. Unauthorized hiding or degrading of displayed advertisements.
  6. Unauthorized access or excessive load on infrastructure.
  7. Impersonation, false information, or misleading statements.
  8. Collection or disclosure of personal information of others.
  9. Obscene, discriminatory, violent, self-harm promoting, abusive, or otherwise harmful content.
  10. Adult, dating, or equivalent inappropriate-use contexts.
  11. Political or religious solicitation use.
  12. Defamation, harassment, or use harming social reputation of related parties.
  13. Concealing rights ownership, or excessively editing in a way that causes misunderstanding of copyright ownership.
  14. Using materials/images for generative AI analysis or prompts against the rights holder's clearly expressed intent.
  15. Producing/selling/distributing goods or content where generated images are a primary component (for example, merchandise or redistributable assets).
  16. Registering trademarks, designs, or copyrights to claim exclusive rights over generated images.
  17. Reproducing or publicly transmitting the service program/source beyond permitted scope without permission.
  18. Any other act the company or rights holder deems improper.

Article 6: Suspension or Interruption

The company may suspend or interrupt all or part of the service without prior notice for maintenance, force majeure, outages, or other operational reasons, and is not liable for resulting damage.

Article 7: Disclaimer and Limitation of Liability

  1. The company does not guarantee defect-free operation, reliability, accuracy, security, fitness for purpose, or non-infringement.
  2. The company and rights holder are not liable for damages arising from use of the service, subject to mandatory consumer protection law.
  3. In limited cases where liability applies, scope is limited as stated in the official terms.
  4. The company is not responsible for disputes between users and third parties.
  5. The company has no obligation to store/backup user-created images; data may be lost when browser state is cleared.

Article 8: Service Changes or Termination

The company may change service contents or discontinue service without notice, and is not liable for resulting damages.

Article 9: Changes to These Terms

Terms may be modified when necessary. Changes become effective by posting on the official website at least one week before the effective date. Continued use after changes is deemed acceptance.

Article 10: Notices and Communications

Notices and communications between users and the company are made through methods designated by the company.

Article 11: No Transfer of Rights/Obligations

Users may not assign or pledge contractual status, rights, or obligations without prior written consent from the company.

Article 12: Governing Law and Jurisdiction

  1. These terms are governed by Japanese law.
  2. Disputes are subject to the exclusive jurisdiction of the court with jurisdiction over the company's head office location.
